I completely agree. I most always use theme templates just as they are with no changes.
However, on some of them I make minor changes, usually color, header, etc.
I only do this after visiting the designer site and checking to see if they allow that. A lot of them use the Creative Commons Attribution-Share Alike license which will allow you to make some changes but you must always keep the original designers link on the page.
In this case it is blatantly stealing because template monster states that you cannot resell it's templates. If you don't like that, then don't buy from them.
I'm sure this guy/girl did "bust his ass" modifying the template but that does not make them THE DESIGNER, so they shouldn't be passing themselves off as such in any way.
I'd be seriously pissed if I purchased a DESIGN in this situation.
