Topbucks and tube sites (legal threats)

I have seen program owners not letting me use pictures for picposts.......and the worst was being told that if I was going to use them on blogs they would can my ass out of their program. (I even sent numerous articles on blogging dating from 2005......and was told blogs were for kids)

Weve got a few aff with rebranded vids on tubesites. Its against our TOS but for now were allowing it IF they put the aff url underneath or redirect and send signups. Rebranding to some surferboard is obviously something else.

Im pretty sure TB doesnt want rebranded, maybe - if theyre here - they can reply.

Apparently from what I was told the issue is with people overwriting the watermarks. I might be wrong because it isn't from the owners mouth but thats what I heard the issue is..

I gotta admit .... eventually watermarks on content will be a no go, but nowadays it is the way things are and in response to the question ... there is no way we would want people removing our watermarks on Titanbucks content so fair enough

I have seen a couple of other sponsors say they did not want to be used on Tube Sites. If the material posted ( video or videos ) is the sample videos being give out by the sponsor and the video links to the affiliate ID I can see no problem. I think a lot of sponsors are simply uneducated or possibly don't want to change. Well you better change because new sponsors come along all the time that will change and they will end up loosing out in the end. If your a sponsor and you don't want your 30 sec to 1 min videos on Tube sites you need to offer embeddable videos your self.

I was just thinking about this the other day... the net is getting a bit boring IMHO and needs something new .. I was wondering what "new thing" would be the next hit? Tubesites are obviously the current "thing".. but where does it go next? I don't have to tell all of you webmasters that the way to make a profit is innovation b/c you are the masters of ingenuity .. (go figure why a sponsor would not want to "spread their wings?")

I remember (and I'm sure a many of you do as well) back when TGPs were new... and there were plenty of people sayin' they wouldn't make it....

Its all about the license, ok if I am a content provider and I say, you can use the content on your site, and you may give the content to affiliates to use on there sites and affiliates can put it on sites they dont own. then tube is covered, but content is not normally bought with 3rd party in mind. You have party of content buyer (sponsor) content to the second party(webmaster) this is normal agreement, but when you have second party (webmaster) useing it on sites that are tube sites (third party) the third party is not normally included. Tube sites and Pic posts are third party..

Is topbucks in the wrong, If they had a content provider sending them warnings that there content license was in jepordy, then no there not in the wrong, but they could of handled with a little more charm, but sometimes sugar coating is not included..

I have not received a notice from their legal department (yet), but do use their content on tube sites.

- Don't add your own watermarks that interfere with theirs.

- Make sure you register the domains you will be using their content on by adding them to the domain list in the TopBucks administration area.

The tubes for me have been great. I have always asked the sponsor first and most have been great about it, even very helpful in getting me the newest vids to use. With all the copywrite issues with youtube and such the adult tubes seem to be on the right side of this where they are fallowing rules instead trying to set a legal precedent which youtube seems to be doing (YouTube Pays No Royalties to artist for the vids or music they host) This is an example of how our industry (adult online marketing) follows rules (k the honest ones do) and some mainstream sites think (youtube ) they are above the law and can make their own rules.

I get a notice from another program to delete the videos off from tube sites.
The demand was not from the program, but from the content provider, so i guess it allso matter what kind of license the content is baught under.

If the content is exclusive for the program, i just don't see the need to say "no, thank you" to any traffic...shite...they even accept TGP traffic
