You're quite wrong. It will never be legal as long as it's based on someone elses work, without their permission/proper licenses.

I completely agree. I most always use theme templates just as they are with no changes.

However, on some of them I make minor changes, usually color, header, etc.

I only do this after visiting the designer site and checking to see if they allow that. A lot of them use the Creative Commons Attribution-Share Alike license which will allow you to make some changes but you must always keep the original designers link on the page.

In this case it is blatantly stealing because template monster states that you cannot resell it's templates. If you don't like that, then don't buy from them.

I'm sure this guy/girl did "bust his ass" modifying the template but that does not make them THE DESIGNER, so they shouldn't be passing themselves off as such in any way.

I'd be seriously pissed if I purchased a DESIGN in this situation.

I guess to each his own then. You do bring up valid points and I would also be upset if he was promoting them as origional works. I was not aware that he was and can see how a purchaser would be upset. Personally I would not mind using his templates knowing that he changed them from someone elses origional design, as I know how much work he put into the recreations, but that is just me.

There is no grayzone here. Either they/he had permission to re-sell the templates, in which case it is legal. Or they didn't, in which case it's ILLEGAL, regardless of their skills, how good they are at drawing, how easilly they COULD'VE done it if they hadn't stole it.

Xyjak never stoled anything from anyone. Look at yourself before you look at others blunts. Ohh looks like he doesn't know how to spell either from the looks of his post. I want to also mention that he likes to post people's photos and private online information on message forums as well. This guy has no credibility. And if Steveo gets booted for saying these things, so be it. At least I got the information out there to the people. Take it and do what you will with it. I'm sure they didn't pull the site cause of him, it's probably because of ismokeblunts, see ismokebluts didn't like the richpornfreak so he went to our hosting company and tried to get our account pulled also by sending them a nice long letter saying we run illegal sites and scam people.. lol What he didn't know at the time is that we were moving servers so for 2 days our site was down, he went around telling people on GFY that he had our account suspended.. My hosting company laughed at him. This is his MO, is to email your host, so I would infact bet that ismokeblunts emailed this guys host to make up some shit story on he he's stealing stuff from people to get his site pulled. Beware this guy has some major serious problems just ask the owners of hosthead.

i was really saddened by the demise of Xyjak. i actually had placed some orders for some work (mainly programming changes to the WP core) just before all this came to a head. i did think that i had lost my cash but no, he was true to his word and even provided a lot of aftersale support. i told him to let me know if he was going to start up again as i wanted to remain a customer but he said that now his rep has been destroyed, there was no point.
This was a real shame as i found his work very good and he seemed very trustful, i am also lead to believe via my own research that the themes in question were actually supplied to him by a third party.
oh well.

Rogue, I believe he still has a mainstream design site.

He did 2 designs for me, one which I could not use and fought with him over a refund which he refused to issue (2checkout did, though) and another, one which had a custom toon I really liked. But once the accusations came out, I was afraid to use the one good design in case it was stolen, so deleted it for a refund.
