The Collapse of the Affiliate Marketing Model

The Collapse of the Affiliate Marketing Model

The Commission Junction and the 2Much Media/NATS Complaints seem to be on track to collapsing the Affiliate Marketing Model which has become like a giant pyramid scheme. With several of the largest Affiliate Programs claiming double digit losses in revenue and/or market share the reasons are multifaceted and so many areas need to be addressed.

The re-filing of the 2Much Media (NATS) case last night may broaden the scope of the hit on the adult industry.

A copy of the Commission Junction Complaint can be found here http://www.cjclassaction.com/Carrier...aint_Final.pdf

A copy of the new 2 MuchMedia Complaint will be provided as soon as it becomes available.

Shellee, I bet $5 that John contacted you within 2 minutes of making this post. John has that way about him. He CONTSTANTLY contacted me EVERYTIME I made a post about him or nats that he didn't approve of. From the security issues they had, to the merger with segpay, to him putting off paying a charity for 3 months

When you make a comment about John, be prepared for ICQ convo. Until you piss him off to the point he puts you on ignore, but that takes a lot of work.

Ok are the little ICQ elves working overtime? Yes he did and he wanted to know everything I knew but he has seen me at every show and even met me a few times and everyone knows I have been talking about my concerns with affiliate software programs and even have been following the Commission Junction Law Suit closely; so maybe his interest in wanting to know what I know and feel came a little too late.

The truth - I talked to everyone I could this past year since I was new and I wanted to learn as much as possible. In doing so I got a lot of infrormation good and bad about companies.

My biggest concern with this case is this:

h. Violation of New Jersey’s Identify Theft Protection Act, N.J.S.A.
56:8-161 et seq.;

I believe it is $10,000 per violation in New Jersey. Does anyone have any idea how many consumer's processed their information through NATS. If 2 Much Media actually was aware of a security leak between them and the Billing Company why didn't anyone put out a fraud security announcement to the consumers? If this is true - How long have they been sitting on this information and doing nothing?

Please feel free to contact me with any information you have on this case or any others that may be of interest to adult surfers/consumers and protecting them.

Hey you are welcome to hit me up anytime. It will be in the best interest of those in bed with 2 Much to stay neutral having just reviewed the power they have over your businesses. So, I can understand if peopple are scared to agree or disagree right now.

On the other hand if those fines get trinkled down that could wake a few people up. If the government or adult hater groups was ever looking for an in to shut down adult companies this may be their opportunity despite innocence of guilt. Read the points filed in this case....

Amended and Supplemental Complaint as against Too Much Media, LLC (incorrectly named herein as “Too Much Media, Inc.,” hereinafter “TMM”), John Albright (“Albright”), Charles Berrebbi (“Berrebbi”), Fred Schank (“Schank”), and John Doe Defendants 1 through 30.

Specifically, by this motion, Plaintiffs seek to amend and supplement their First Amended

Complaint as follows:

1. Pursuant to Rule 23 of the F.R.C.P., to assert a class action against
Defendants for the following causes:

a. Violations of New Jersey’s Consumer Fraud Act, N.J.S.A. 56:8 et
seq.;

b. Negligent Misrepresentation;

c. Misappropriation and Conversion of Proprietary Confidential
Information;

d. Breach of Contract;

e. Intentional Interference with Existing Affiliate Contracts and
Memberships;

f. Intentional Interference with Prospective Business and Economic
Advantage;

g. Breach of Fiduciary Duty;

h. Violation of New Jersey’s Identify Theft Protection Act, N.J.S.A.
56:8-161 et seq.;

i. Indemnity and Contribution; and

j. Declaratory relief.

BUT if I am off base here in my opinion then please inform me of otherwise - I am easy to get ahold of.

I don't run NATS on my paysites. So I have no horse in this race.

Has there been any proof that information compromised was anything other than email? I believe I read that credit card details aren't stored with the sponsor, only with the biller, is this correct?

The only thing that will collapse the affiliate model is if they don't get paid for the signups they find. Oh wait, that's on the increase isn't it.

Shellee. I would like to know the following please.

1. Why do you re-post old news? Why did you re-post this on multiple sites?

2. Why do you constantly confuse the names 2Much Internet and TooMuchMedia? (Nobody else does!). And why do you continue to do this even after this "mistake" of yours has been pointed out to you several times in the past? If it is not a mistake, why are you intentionally trying to "blur" the distrinction between our two companies? (thank you though, We love John & Charlie and are happy to be associated with them in any way we can.

3. Exactly why should people contact you regarding this matter? What services will you provide to those concerned about TooMuch? What will you do with the information they provide to you? (Just curious!)

4. Why did you call this thread "The Collapse of the Affiliate Marketing Model"? It's pretty alarmist, wouldn't you say?

Hi Pam,

No worries! This will remain civil. I am just asking Shellee some questions especially since she went out of her way to mention our company name several times in this post which has nothing at all to do with us.

It's been a dead post for several weeks now and Shellee Hale, or whoever the hell the person is, hasn't posted since. I can understand protecting your company name and making the clear distinction, but the thread and poster have been inactive here for weeks now.

Panky,
You're right. It's just getting sick and tired seeing the same post on every forum these days..

Globofun,
Thank you!

Sarettah,
It's another post, another thread, another forum. And as I said above, I'm tired of seeing the same messages and the same fake confusion from Shellee Hale every forum I go to.

Let's end it with this: Shellee, kindly keep our name out of all of your future messages. Thank you.

You made a deal. You broke the deal. The deal did not mention a particular board, thread or post.

You broke the deal. That plain and simple.

When someone misrepresents my company by purposely and repeatedly confusing our name with that of another company who is involved in a lawsuit, it is my responsibility to my company to point it out.

Despite any "deal" I made with you, it did not extend to ignoring that responsibility to my company on other forums, especially Netpond.
