NDA for writers and designers?
What do you think of using an NDA -- non-disclosure agreement -- with writers and designers?
I had someone doing work for me make a few posts about what they were doing for me without any thought to confidentiality. I had to ask them to shut up and stop posting on lots of forums about my projects (this is not a recent thing). While at the outset it sounds like a good idea ... I know a lot of people aren't apt to give out their full name, address and details to a webmaster wanting them to do work. But without that, I have no legal recourse, and of course an NDA is a legal document. And, let's face it, not all people we hire are in the USA. How about a simple, "Don't talk about my fucking projects to anyone or post on any forums and you'll be paid when done. Mention it and your payment is fucked." (half said in jest, you get the idea) |

A non disclosure or confidentiality agreement is customary, IMO. It can just be single paragraph that is part of what you stipulate for the rest of the terms, payment, delivery date, and so on.
I think most people don't think twice about blabbing, and are probably just stoked they're working, or happy about their project. They just need a reminder that this business is highly competitive, and to keep specifics to themselves. |

Yeah I think you'd be at least covering your ass somewhat Pam. It should at least be a stipulation in the agreement that what someone works on is not to be shared with anyone prior to the work being released for public view (if thats your intent).

not only that. For example when somebody is selling domains and somebody buys via private message and the seller post public : sites sold to "nickname". It sucks, maybe the buyer wanted to remain anonymous. Sometimes people just do not think

I know when I inquired about buying a paysite someone was selling I had to sign an NDA that I'd never disclose revenue, etc. And, I never have and never will. A contract for things is good but when someone is in Outer Mongolia, well, it's not easy to go after them ![]() Fresh -- I know when I buy a domain I'll usually ask they not announce it anywhere as I prefer my business to be just that, but I agree, some just don't think |
