The proof is not in the pudding.....it's in the TOS.

Phrases like "Reasonable Usage", or "within the boundaries" are big flags. I get a kick out of reading the TOS section about how you have unlimted disk storage, as long as the files are not larger than 100k. I. E., you can store all the htm files you want, just don't store any large binary files.

In the end, the TOS holds all the water.

disclaimer - I'm not a TOS expert. The extent of my experience is:

1. reading dozens of them to educate myself
2. working with my attorney in an effort to compose the TOS for my site.

It was a very good experience.


For what it's worth - that 'unlimited' phrase in the post seemed doubtful to me. I wish I had such a deal.

I'd just like to throw in here that Tube sites themselves are not the evil enemy. They don't give away more free content, and in most cases they give away LESS than an MGP.

Most tube sites have a few thousand clips in their database. Many TGP/MGP's have 10's of thousands of galleries in their database.

The assholes giving away the full-length pirated shit are the problem. Not the tube site. Any one of these morons could have opened an MGP and put full length movies in there too. It wouldn't mean MGP's were suddenly the downfall of the industry.

I think in many ways the tube site model is superior to TGP/MGP's. It gives the webmaster tons of advertising space that he wouldn't have on a TGP. For some reason many webmasters have decided to fill all this extra space with more clips instead of more advertisements, but again, that's just a dumb webmaster, not an evil site model.

I saw one tube site today and it's full of 30min+ clips !!! Only they use are ethology ads, [mostly all are AFF links]. How the fuck they made money to pay bills for hosting and how the fuck nobody shut them down for using illegal content?

It's not strange conversions are totally fucked when surfer can watch for free...
