A warning to all amateur models and networks

Just so everyone knows I have commented about a certain network out there in previous posts. The net works practices draconian tactics with its models and even goes as far as having them sign away their rights. I will not support this behavior and feel that others should be warned of it before affiliating themselves with this network. The information below is provided so that each of you may make your own decisions. Photo Exchange BBS is also known as Southern Charms, or SC of short.


BINDING ARBITRATION.
a. Arbitrable Claims. All disputes between Artist and Photo Exchange BBS, Inc. (and their respective attorneys, successors and assigns)of any kind whatsoever, arising from the transaction reflected in this Agreement ("Arbitrable Claims") shall be resolved by arbitration.Arbitrable Claims shall include, but are not limited to, contract and tort claims of all kinds, and all claims based on any federal, state orlocal law, statute, or regulation, excepting only claims under applicable worker's compensation law and unemployment insurance claims.Arbitration shall be final and binding upon the parties and shall be the exclusive remedy for all Arbitrable Claims. THE PARTIES HEREBYWAIVE ANY RIGHTS THEY MAY HAVE TO TRIAL BY JURY IN REGARD TO ARBITRABLE CLAIMS.b. Procedure. Arbitration of Arbitrable Claims shall be in accordance with the Employment Dispute Resolution Rules of the AmericanArbitration Association ("AAA Employment Rules"). The losing party as identified by the arbitrator shall pay the fees of the arbitrator.


Excerpt from email sent to model:

You have a site on FreakMommas which is a restricted site. Of course, we can not force you to not have a site there, but you do have to make a choice. We will not allow anyone who has a site on any of the Freak Daddy sites to be on SC. It is entirely your choice and you have to make it. Let us know within 48 hours if you want to retain your site (shown below) on FM. If you do, there is no problem and we will remove your SC site.

Ive been wanting to talk about this for a long time but am scared I will lose my site if I say some thing negative about what is going on. I am so sick and tired of Southern Charms trying to control us like this. At first I was ok with there rules but now I am not because it has nothing to do with anything but Dick himself using us to get back at Cyrix. I dont really like you Cyrix because of the mean things you say and do. But I admit you are right about so many things and it kills me knowing that the person behind the net work I am partners with is totally fucking up. I just hope William will put a stop to this before things get worse. I wish I could tell Dick to fuck off but I need my income. But just so you know alot of us girls share the same feelings about what is going on. We talk about it in private and emails. And just because we dont talk about in public or on your forum it doesnt mean are on Dicks side. Dick is going to ruin Southern Charms. I cant stand up to him face to face but I need to let out my feelings before I burst.

If I tell you my name I will lose my site. Dick controls more than a network. This is sad and I am guilty of letting him. I know I am pathetic and it kills me.

I would advise all amateurs to look into this on your own....there is a big war with a "lil" group on the net and those at Southern Charms. Just remember there are two sides to every story

Your right there are two sides heck there are even 3 or 4 sides lets look at another side.

I'm the Haydee in question, they took down my new page at SC just as I was gonna put up new pics amd everything...I've been contacting EVERYONE on their list to try to get help because my password all of sudden stopped working, but it's been days and not even one response explaining their actions. I've been directing my old customers to my other site on ATC. So hopefully I can get some more publicity to make up for the money SC never paid me.I didn't even know my page was gone till a customer told me.

the reason I left Southern Charms was so I could practice my freedom of speech, freedom to associate, and freedom to do business with whom I ever I want without being ridiculed, silenced, or made to feel guilty for my personal opinions and choices. Shall we talk about the sides more?

SC does not care about their models they do not care about their clients I say for if they did do you think they would just shut a site down in the middle of the night leaving the Model and the clients in the dark?

Yeah that is the kind of business practices I DO NOT want to associate my site with.

Now run back to Dick and tell him I am posting over here and to get his lawyer to send me a letter like he did to FD.

Or have one of his models file a DMCA complaint with my billing company, oh wait I dont have any content from any SC model on my site.

So do you think that anyone is going to feel safe working with SC when they are known to hunt models off other networks, get the models to file bogus DMCA complaints in a attempt to get another networks billing shut down. And send threatening letters from their lawyers to intimidate others?

You say there are two sides to every story. I say to this story there are hundreds of sides. There is each Network that SC has on their ban list, each model SC has just shut their site off in the middle of the night, and each client that the next day they wake up to the models site they payed for is gone. Which there are complaints about that and other things over at ripoff report.


NetPond is about working together not intimidation, backstabbing and cheating and attempting to dictate to others what they can and cant do. That is why I posted this warning to those in this community. It is up to each webmaster model and others to decide the course they choose to take I just post what I know.

If Dick or William have anything to say as to their actions I invite them to come on over and post. I am sure everyone here would love to hear their side of the story.

Personally I was going to join SC but I do semi nude, they want spread leg shots, and exclusive material. I could list the mirade of reasons I did not choose them but those two were up there. I don't like anyone having rights to my stuff period.

Really then why are all your websites built in frames from 1991 that search engines can't read?

Why is it that hot girls over the period of a couple years rarely see their paychecks go up and down within $75 dollars?

Why is it if they try branching out from SC they will terminate them?

Why is it if you throw a quarter on the ground 50 chicks will dive for it?

Im not gonna argue over something I know for a fact - just letting people know that I HAVE been on both the "haters" site(s) and SC and I am still on SC. Bottom line.

Rights is one thing, exclusive rights is another. You can give 50 people rights to use your material and make money from 50 different sources, or you can give exclusive rights, and then only get to make money from 1 source which is what SC asks for. All your eggs in one basket. We know what that means.

CumSlutKylie, you were with SC and then left abruptly. You then got married and went back to SC. Tell them all of that.

Towards the end of May 06, you came to me and said “I want to start a web site with you”; you already had your own domain web site and Southern Charms site going. I told you I thought you had too much on your plate to take on a third web site and I suggested that you not do it. You were feeling frisky and a bit tweaky, if you know what I mean, and said “no no no, I wanna do it”. You were with the FreakDaddy Network for less than twenty eight days and then left. In this day and age, you expect a web site to thrive and do well with two other sites with the same sorta content of you to compete with in only twenty eight days? You wonder why I got upset at you for leaving? You wasted my/our time...

Cyrix, I never said anything about our time / effort on your site(s) and Im not dissing you for that here...Im only pointing out that girls need to decide for themselves where they want to work - and its not smart to publicly badmouth other sites because it makes you look bad. We attend several events each year and never have had any drama at any of them even one time. Yea, a lot of girls say the same thing about SG, but everyone knows they are a horrible company to work for. I haven't worked for SC, but from everything I've read, from previous models, etc, I wouldn't want to for the same reason I told SG to shove the contract up their ass....
