There might be some precedence over this. Do you remember when Yahoo was complaining about the s e x . c o m wildcard dns setup, because yahoo.s e x.com would resolve instead of error?

I myself try and stay away from TM issues as the hassle and problems associated are not worth it

Trademarks apply wherever they are used or misused. They apply in meta tags, and site content, so I don't understand why anyone would believe that they don't apply to 3rd level sub-domains. What the guy may be getting confused over is that WIPO doesn't apply, but this is only because it controls registry entries, and 3rd level names are resolved in the hosting DNS and not at registry level.

Disputes would need to be settled by the courts and not WIPO.
